Insolvency Tax Matters
The Firm maintains a sensitivity to the tax issues
which arise in insolvency cases, recognizing taxes can
have significant and unexpected consequences in
work-outs, liquidations and reorganizations. The Firm
counsels individuals and businesses facing serious tax
issues respecting the various alternatives available for
addressing those issues.
Most recently, in the American Basketball League
case, Mr. St. James successfully proposed a re-working
of the Plan of Reorganization in order to protect and
preserve critical Net Operating Loss carryovers.
Mr. St. James was a panelist in the program "A
Dozen Ways to Commit Malpractice (Without Even Knowing
It): Tax Issues for Bankruptcy Practitioners"
sponsored by the Bay Area Bankruptcy Forum.
Mr. St. James was actively involved in addressing
bankruptcy tax issues in connection with the National
Bankruptcy Review Commission’s efforts to propose an
overall revision to the bankruptcy laws. He was a
contributor to the Task Force established by the
Taxation Section of the American Bar Association to
present the ABA’s analysis of bankruptcy tax issues to
the Review Commission.
Mr. St. James was also a panelist at a round table
discussion of bankruptcy tax issues presented at a
session of the National Bankruptcy Review Commission
sponsored by the National Conference of Bankruptcy
Judges.
Mr. St. James is the author of "Federal Tax
Liens – Making Bankruptcy Attractive for
Creditors", which was published in The Business
Lawyer, the law review of the Business Section of the
American Bar Association.
