Consistent with its Silicon Valley practice, St.
James Law is attuned to the unusual issues arising at
the intersection of intellectual property and insolvency
law.
In the Orca Technology
case, Mr. St. James fashioned a unique marketing plan
for certain patents which resulted in an in-court
auction at which the bidding started at $225,000 and
ended at $3.65 million. Summarizing his efforts, the
Court praised "the unique knowledge, skill and
expertise of counsel" which gave rise to results
which "exceeded all reasonable expectations".
More recently, Mr. St. James delivered a presentation
to the annual meeting of the American Chemical Society
on "Intellectual
Property in Bankruptcy: Negotiating and Drafting Issues
for Licensees and Licensors."
St. James Law’s sensitivity to intellectual
property issues has made it well suited to representing
companies acquiring the assets of insolvent high-tech
businesses. The Firm also assists high-tech
businesses in addressing cash flow problems by
re-negotiating with key licensors/licensees and by
engaging in work-outs with creditors generally.
